Appellate Litigation Department
Appellate Litigation demands an attorney:
i) familiar with the appeals process,
ii) able to persuade and zealously advocate for the client both verbally and in writing; and
iii) willing to do the legal research necessary to cogently and clearly convince the court that the position the attorney defends is correct on the facts and on the law.
Mark Miller, Chair of our Appellate Litigation Department, has spent more than a decade in the trial and appellate courts of our state and federal courts doing just that. Whether defending the result below or explaining why the result must be reversed, his writings have consistently been commended by the courts as well-reasoned and persuasive.
By working with the Firm’s many experienced trial attorneys from the beginning of each case, Mark ensures that the legal issues that may arise are either headed off, or dealt with in a manner that will allow for the greatest success possible.
Many of our cases involve important legal issues that often lead to appeal. For this reason, having an experienced appellate attorney in the Firm is invaluable.
We have obtained judgments and large settlements for clients in complex cases based on our ability to position the case on the law in a way that makes trial a risk our adversaries are unwilling to take.
Besides representing the Firm’s clients on appeals and trial courts on important legal issues, our Appellate Litigation Department is also available to serve clients and attorneys who are faced with a need for an appellate specialist to handle an appeal, or to draft the trial document necessary to obviate the need for an appeal. Our Appellate Litigation team has handled appeals (and legal issues at the trial level) in many areas of the law, from criminal law to commercial.
Most importantly, our Appellate Litigation Department will honor the bond between trial attorney and client, and will solely act as the appellate attorney.
