Appellate litigation has become a specialized practice area largely because of the varied duties that all must be performed exceedingly well to be successful on appeal.
A successful appellate attorney not only will need to have superior writing talent, that attorney also will need to be a persuasive arguer, skilled in the art of either obtaining, or opposing, discretionary appellate review, and possess the ability to work well with others in a timely and successful manner.
Because Mr. Miller has worked at both the trial and appellate levels ‘behind the curtain’ with many judges in Florida, he has a unique understanding of what the appellate judge, or trial judge on a dispositive motion, is looking for when making his or her decision.
Typographical errors, overstatement, unnecessary vitriol towards opposing counsel or the lower court, and misstatement of the law may doom an otherwise winning argument.
Mr. Miller has seen these mistakes firsthand. He avoids these common errors by setting forth the facts and procedural history in a non-argumentative way that nevertheless sets the stage for an argument section that often compels the Court to conclude the position favored by Mr. Miller’s client is the proper one on the facts and law.
