Partners Lorenzo Williams and Paul McMahon Obtain Multi-Million Dollar Settlement for 45 Year-Old Air Conditioning Repairman
Late one winter afternoon, an air-conditioning repairman was driving his Sports Utility Vehicle (SUV) northbound on I-95 in South Florida. He was headed home after attending an air conditioning and repair seminar at a nearby hotel.
At the precise moment he drove on an overpass, a concrete piling, which weighed approximately 21,000 pounds and was 100 feet long, broke and fell out of its cage directly onto I-95 and the client’s vehicle. The force of the impact crushed the roof of the SUV and propelled the vehicle into the I-95 barrier. The accident was so horrendous that authorities were forced to close the highway during the height of rush hour traffic.
The impact of the concrete piling caused such severe damage to the SUV that the jaws of life were used to extract the client from the vehicle. He was flown by helicopter to a nearby hospital after sustaining life threatening injuries and was hospitalized for over three weeks. After enduring several operations, the client was left seriously disabled.
Partners Lorenzo Williams and Paul McMahon argued that the accident was caused by the reckless conduct of the construction companies working on the site. The lawsuit asserted that the companies were responsible for job site safety and establishing traffic control measures to be taken to ensure the public’s safety during the construction project. Yet, no special measures were established to control the flow of northbound I-95 traffic during the construction operations.
The Defendant construction companies denied responsibility for the accident and vigorously defended the case in court before finally agreeing to the settlement on the eve of trial.
