Trial Attorney Willie Gary and Team File $5 Billion Lawsuit against SUBWAY’s Co-Founder and President, Fred DeLuca for Breach of Contract, Fraudulent Conduct and Bad Faith Dealings
West Palm Beach, FL - Prominent trial attorney Willie Gary along with his law partners Maria Sperando, CK Hoffler and Manny Socias of the law firm of Gary, Williams, Finney, Lewis, Watson & Sperando, P.L. filed a $5 billion lawsuit on behalf of Anthony V. Pugliese III and his business against the Co-Founder and President of SUBWAY, Fred DeLuca. The lawsuit was recently filed in Palm Beach County (case # 50 2009 CA 040295 XXXXMB).
Anthony V. Pugliese III and Fred DeLuca were partners who worked together on two major business ventures including the acquisition of roughly 41,000 acres of land, arguably, one of the largest single land and development acquisitions in the state of Florida, rivaling the acquisition of the Walt Disney properties in Orlando. The lawsuit contends that Fred DeLuca and his company FD Destiny, LLC, engaged in a fraudulent and deceptive scheme designed to take Anthony Pugliese’s interest and financial investment in the multi-billion dollar business venture. The lawsuit claims that SUBWAY’s Co-Founder and President, Fred DeLuca is guilty of breach of contract, fraudulent conduct and bad faith dealings, among other things, in regards to his business dealings with Anthony Pugliese.

The lawsuit details the irreparable damage and harm that Fred DeLuca’s bad business dealings caused Pugliese and his company. Pugliese is suing DeLuca and FD Destiny, LLC for breach of fiduciary duty, breach of contract, predatory lending, breach of Florida Deceptive and Unfair Trade Practices Act, breach of the covenant of good faith and fair dealing, fraud in the inducement, negligent misrepresentation, quantum meruit and unjust enrichment.
“Fred DeLuca stole our client’s dream. He became a partner in a multi-billion dollar business deal with our client and made empty promises,” commented Willie Gary. “As a result, Anthony Pugliese put full trust and confidence in DeLuca concerning the financial and business matters of their joint ventures only to be misled, misguided and deceived. Fred DeLuca had every intention of making a secret profit from his business ventures with Pugliese and he plotted and schemed to take our client’s interest in this multi-billion dollar business deal for his own personal benefit,” continued Gary. “It isn’t right and we will not stand for it!”
Gary is no stranger to seeking justice. Gary and his legal team are known for taking on some of the nation’s most powerful corporate giants, including the funeral industry. In 1995, a jury awarded Gary and his legal team a record-breaking, half-billion dollars against one of the world’s largest funeral chains, The Loewen Group. In addition, Gary is noted for winning a $240 million jury verdict in Orange County against the Walt Disney Corporation for his clients who alleged that Disney stole their idea for a sports theme park. In 2001, a jury awarded Gary a $139.6 million verdict for the Maris Distributing Company against Anheuser Busch.
